Description
¶1. John Lee Schaefer appeals from a judgment convicting him of eighteen counts of possession of child pornography, contrary to Wis. Stat. § 948.12 (2001-02).*fn1 He contends that the warrant issued for the search of his home and personal computer was not based upon probable cause and was vague and overbroad. In addition, Schaefer argues that § 948.12, Wisconsin's Child Pornography statute, is devoid of a scienter element and therefore unconstitutional. Finally, Schaefer asserts that charging and convicting him of several counts of possession of child pornography violates the double jeopardy prohibitions of the Fifth Amendment of the United States Constitution and article I, section 8 of the Wisconsin Constitution. We reject Schaefer's arguments and affirm.
